Part A – Email and newsletter
5.1 Newsletter sign-up consent
When you subscribe to our newsletter, you agree to the following:
"By subscribing, you agree to receive newsletters, industry updates, event announcements, and occasional promotional emails from The United States Election Industry Association. You can unsubscribe at any time using the link in any email. See our Privacy Policy."
5.2 Our email practices (CAN-SPAM Act)
- Accurate headers and subject lines. Our "From," "Reply-To," and routing information identify USEIA, and our subject lines are not misleading.
- Identification. Promotional emails are identified as such where required (for example, sponsored content is labeled "Sponsored").
- Physical address. As CAN-SPAM requires, every commercial email includes a valid physical postal address for the Association in its footer. This address is used in email footers only and is not otherwise published in these documents.
- Unsubscribe. Every marketing email contains a clear unsubscribe link that works for at least 30 days after sending. We honor opt-out requests within 10 business days, do not charge a fee or require more than an email address to unsubscribe, and do not sell or transfer the email addresses of people who unsubscribe.
- Transactional messages. Members will continue to receive transactional or relationship messages (receipts, renewal notices, account and policy updates) even after unsubscribing from marketing.
- Email provider. We send email through our service provider, Resend, which processes addresses only to deliver our messages.
- Sponsor emails. If we send messages on behalf of sponsors, they will come from USEIA, follow these practices, and honor your USEIA unsubscribe choice.
Part B – Text messaging (SMS) program terms and TCPA consent
5.3 Text message consent
Our text-message opt-in checkbox is unchecked by default, separate from any other consent (including the Terms of Use, auto-renewal, and newsletter boxes), and placed next to this text:
"☐ Yes, text me. By checking this box, I agree to receive recurring automated marketing and informational text messages from The United States Election Industry Association (USEIA) at the mobile number provided, including messages about membership, renewals, events, the GOTV Awards, and industry updates. Consent is not a condition of membership or of any purchase. Msg frequency varies. Msg & data rates may apply. Reply STOP to cancel at any time and HELP for help. Carriers are not liable for delayed or undelivered messages. See our Terms of Use and Privacy Policy. Mobile information will not be shared with third parties or affiliates for marketing purposes."
5.4 SMS program terms
- Program. USEIA Updates (the "SMS Program") is operated by U.S. Election Industry Association (also known as "The United States Election Industry Association"). Messages may include membership and renewal notices, event and GOTV Awards updates (including nomination, Q&A, and voting deadlines), and industry and advocacy news.
- Express written consent. We send automated or marketing text messages only to people who have given prior express written consent by checking the opt-in box above and confirming. Consent is not required to join, renew, vote, or buy anything from USEIA. We record the date, time, source, mobile number, and consent language for each opt-in.
- Confirmation message. After you opt in, you will receive a confirmation text, for example: "USEIA: You're subscribed to USEIA Updates. Msg freq varies. Msg & data rates may apply. Reply HELP for help, STOP to cancel."
- Message frequency. Message frequency varies.
- Costs. Message and data rates may apply, according to your mobile plan. USEIA does not charge for SMS Program messages.
- Opting out (STOP). Reply STOP (or END, CANCEL, UNSUBSCRIBE, QUIT, STOP ALL, or REVOKE) to any message to opt out. You will receive one final message confirming the opt-out and will not receive further program messages unless you opt in again. You may also revoke consent by any other reasonable means, such as emailing Winning@ElectionIndustry.com. We will honor opt-out requests promptly and within the time required by law.
- Help (HELP). Reply HELP for help, or contact Winning@ElectionIndustry.com.
- Timing. We will not send marketing text messages before 8:00 a.m. or after 9:00 p.m. in the recipient's local time (or within any narrower window required by state law).
- Carrier disclaimer. Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and device and is not guaranteed.
- Your number. You represent that you are the account holder or authorized user of the mobile number you provide. If you change or give up that number, please opt out or notify us so we do not text its new owner.
- Privacy. We handle your information as described in our Privacy Policy (see Privacy Policy). Mobile information, including phone numbers and SMS opt-in data and consent, will not be shared with or sold to third parties or affiliates for marketing or promotional purposes. We share mobile information only with service providers that help us deliver the SMS Program (such as our SMS provider), and as required by law.
- Changes and termination. We may change or end the SMS Program at any time. Material changes to these terms will be posted and texted to subscribers, where required.
- Disputes. The Terms of Use, including the arbitration agreement and class-action waiver in Section 1.15, apply to the SMS Program.
