Terms of Use

Last updated October 25, 2026

1.1 Agreement to these Terms

These Terms of Use ("Terms") govern your access to and use of ElectionIndustry.com and any related pages, forms, emails, and online services (together, the "Site") operated by U.S. Election Industry Association, a Wyoming nonprofit corporation (also known as "The United States Election Industry Association") ("USEIA," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

IMPORTANT: Section 1.15 contains a binding individual arbitration agreement and a class-action and jury-trial waiver. It affects how disputes are resolved. You may opt out within 30 days as described in Section 1.15(g).

These Terms incorporate the following policies by reference: the Privacy Policy, Cookie Notice, Acceptable Use & User-Submitted Content Policy, Copyright & Intellectual Property Notice, Disclaimer & Limitation of Liability, Non-Partisan & Political Disclaimer, and, where applicable, the Membership Agreement and the GOTV Awards Rules.

1.2 Who we are

USEIA is a membership trade association that advocates for the interests of the election industry. USEIA is not a government agency, election authority, political party, candidate committee, or political action committee. See the Non-Partisan & Political Disclaimer.

1.3 Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. If you use the Site on behalf of a company or other organization, you represent that you are authorized to accept these Terms on its behalf, and "you" includes that organization.

1.4 Password-protected areas and accounts

Parts of the Site may be protected by a password or require an account. You are responsible for keeping passwords and login credentials confidential and for all activity under your credentials. Do not share access passwords with people who are not authorized to receive them. Notify us promptly at Winning@ElectionIndustry.com if you believe your credentials have been compromised. We may change, reset, or revoke access at any time.

1.5 Membership, payments, and awards

Membership purchases are governed by the Membership Agreement & Terms. Nominations and voting in the GOTV Awards are governed by the GOTV Awards Rules. Member Data-Removal & Protection Services and the online member directory are governed by Sections 1.19 and 1.20. If those documents conflict with these Terms on their subject, those documents control.

1.6 Acceptable use

You agree to use the Site only for lawful purposes and in accordance with the Acceptable Use & User-Submitted Content Policy.

1.7 Content you submit

If you submit nominations, comments, photos, logos, bios, or other content ("User Content"), you grant us the license described in the Acceptable Use & User-Submitted Content Policy. You are responsible for your User Content and represent that you have the rights needed to submit it.

1.8 Our content and trademarks

The Site and its content – including text, graphics, logos, the names "The United States Election Industry Association," "USEIA," and "GOTV Awards," and the design of the Site – are owned by or licensed to USEIA and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from Site content. You may view and print pages for personal or internal business, non-commercial use, provided you keep all copyright and other notices intact.

The Site uses and may link to third-party services (for example, our payment processor, Stripe). We do not control and are not responsible for third-party websites or services, and your use of them is governed by their own terms and privacy policies.

1.10 Changes to the Site

We may change, suspend, or discontinue any part of the Site at any time, without notice, and without liability to you.

1.11 Disclaimers and limitation of liability

The Site is provided "as is" and "as available." Your use of the Site is subject to the Disclaimer, No Professional Advice & Limitation of Liability (see Disclaimer & Limitation of Liability), which is part of these Terms.

1.12 Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless USEIA and its directors, officers, employees, volunteers, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Site, (b) your User Content, or (c) your violation of these Terms or of any law or third-party right.

1.13 Termination

We may suspend or terminate your access to the Site at any time if we reasonably believe you have violated these Terms or if needed to protect the Site, our members, or the public. Sections that by their nature should survive termination (including 1.7, 1.8, 1.11, 1.12, and 1.14–1.16) will survive.

1.14 Governing law and venue

These Terms, and any Dispute (as defined in Section 1.15) between you and USEIA, are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Section 1.15 is also governed by the Federal Arbitration Act. USEIA is a Wyoming nonprofit corporation. For any claim not subject to arbitration (including claims excepted under Section 1.15(c) and claims by anyone who has opted out of arbitration), you and USEIA consent to the exclusive jurisdiction and venue of the state courts located in Los Angeles County, California, and the United States District Court for the Central District of California, and you and USEIA waive any objection to personal jurisdiction or venue there.

1.15 Binding individual arbitration and class-action waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS.

(a) Agreement to arbitrate. Except as provided in subsection (c), you and USEIA agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, your membership, the GOTV Awards, or any communications from us (including text messages), whether based on contract, statute, tort, or any other legal theory ("Dispute"), will be resolved by final and binding individual arbitration, not in court.

(b) Informal resolution first. Before starting arbitration, the party with a Dispute must send the other a written notice describing the Dispute and the relief sought (to USEIA by email at Winning@ElectionIndustry.com). The parties will try in good faith to resolve the Dispute informally for 30 days.

(c) Exceptions. Either party may (i) bring an individual claim in small-claims court if it qualifies, and (ii) bring a claim in court for injunctive or other equitable relief to protect or enforce intellectual property rights (copyrights, trademarks, trade secrets, or patents). (iii) Any claim for public injunctive relief that cannot be waived or arbitrated under applicable law (for example, California law) will be severed and stayed until the arbitrable claims are resolved, and then decided in court under Section 1.14.

(d) Rules and administrator. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (and, for business-to-business Disputes, its Commercial Arbitration Rules) ****, as modified by this Section. The Federal Arbitration Act governs the interpretation and enforcement of this Section. A single neutral arbitrator will decide the Dispute and may award any individual relief that a court could award, but only to the individual party seeking relief.

(e) Location. The arbitration will be seated in Los Angeles, California (Los Angeles County), and any in-person hearing will take place there or, at the claimant's election, the arbitration will be conducted remotely by video conference or on written submissions. Payment of filing and arbitrator fees will be governed by the applicable rules.

(f) Class-action and jury-trial waiver. YOU AND USEIA EACH AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR ARBITRATION. YOU AND USEIA EACH WAIVE THE RIGHT TO A JURY TRIAL. The arbitrator may not consolidate more than one person's claims.

(g) 30-day right to opt out. You may opt out of this arbitration agreement by sending an email to Winning@ElectionIndustry.com with the subject line "Arbitration Opt-Out," including your name and the email address associated with your use of the Site or membership, within 30 days after you first accept these Terms (for example, by joining or first using the Site). Opting out does not affect any other part of these Terms. If you opt out, Section 1.14 applies.

(h) Severability. If the class-action waiver in subsection (f) is found unenforceable as to any claim, that claim (and only that claim) will be decided in court under Section 1.14, after any arbitrable claims are resolved. If any other part of this Section is found unenforceable, the rest remains in effect.

(i) Survival. This Section survives termination of these Terms and of your membership.

1.16 General

These Terms (with the incorporated documents) are the entire agreement between you and us about the Site. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, or transfer of the Site. Headings are for convenience only.

1.17 Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date and, for material changes, may provide additional notice (such as by email to members). Continued use of the Site after changes take effect means you accept the updated Terms.

1.18 Contact

Questions about these Terms: see the Contact Information Block (see Contact).

1.19 Member Data-Removal & Protection Services

(a) What the service is. As a benefit of active membership, USEIA provides personal-data removal and protection services (the "Data-Removal Services"). The goal is to reduce how much of a member's personal information is exposed online, and to stand with members who are targeted. The service may include:

  1. Data brokers and people-search sites: submitting opt-out, deletion, and suppression requests to data brokers and people-search websites that list the member's personal information, and re-submitting when listings reappear including, for California residents, assisting with requests through the California Delete Request and Opt-out Platform, where available;
  2. Search engines: submitting removal or de-indexing requests to search engines for results containing personal contact information (e.g., home address, personal phone, personal email), doxxing content, non-consensual intimate imagery, or other content eligible under the search engine's own policies;
  3. AI services: submitting correction, removal, or opt-out requests to operators of AI chatbots, answer engines, and models (for example, requests to correct inaccurate statements about a member or to exclude personal information from outputs or training, where the operator offers such a process);
  4. Social media: filing impersonation, fake-account, harassment, doxxing, and other policy-violation reports with social media platforms;
  5. Dark web monitoring: monitoring known breach data, paste sites, and dark-web sources for the member's designated identifiers (e.g., email addresses, phone numbers), alerting the member to exposures, and recommending protective steps. Content on the dark web generally cannot be removed; this part of the service is monitoring and alerts; and
  6. Ongoing monitoring: periodic re-scans and follow-up requests during the membership term.

(b) When it begins. The Data-Removal Services begin after a member joins and completes the Data-Removal Authorization and intake form described in subsection (d). Initial requests are typically submitted within 30 days after intake is complete. The service continues while the membership is active and paid.

(c) Best efforts only – no guarantee. USEIA will use commercially reasonable efforts, but does not guarantee that any information will be removed, de-indexed, corrected, or kept off any site, service, or AI system, or that any particular result will be achieved. Data brokers, search engines, AI operators, social media platforms, and other third parties control their own systems and decide whether to honor requests. Information may reappear, may be republished from other sources, or may remain in archives, caches, backups, and AI models. Removal times vary and are outside our control.

(d) Authorization and appointment as agent. To receive the service, each covered individual must sign (electronically) a Data-Removal Authorization. By signing, the member: (i) authorizes USEIA and its service providers to submit requests in the member's name; (ii) appoints USEIA (and its designated service providers) as the member's authorized agent for submitting opt-out, deletion, access, correction, and similar requests under applicable privacy laws and site policies; (iii) authorizes USEIA to communicate with third parties about those requests; and (iv) agrees that USEIA may provide the member's identifying information to third parties as reasonably necessary to verify and process the requests. The member may revoke the authorization at any time by email to Winning@ElectionIndustry.com. Revocation ends the service for that individual.

(e) Member responsibilities. The member must provide accurate, current, and complete information (such as names and former names, current and former addresses, phone numbers, and email addresses), may only submit information about themselves (or, for firm memberships, about designated individuals who have signed their own authorization), and must tell us promptly about changes. The member must cooperate with verification steps third parties require (for example, clicking a confirmation email).

(f) Limits – what we do not do.

  • Lawful and public content may remain. Public records (e.g., court records, property records, campaign-finance reports, lobbying disclosures, corporate filings, and voter-file data where public by law), news reporting, and other lawful content may not be removable. We will not attempt to remove information that the law requires to be public.
  • No suppression of truthful reporting about misconduct. We will not seek removal of accurate news reporting, court records, regulatory actions, or other truthful information about a member's alleged or actual misconduct, and we will not file false or misleading takedown requests or abuse any platform's reporting tools.
  • Not legal advice; no legal representation. The service is not legal advice and does not create an attorney-client relationship. We do not file lawsuits, send legal demand letters for members, or represent members in disputes. Members needing legal action should consult their own attorney.
  • Not a credit-monitoring, identity-theft insurance, or security service. We do not provide identity-theft insurance, credit monitoring or repair, or incident-response services, and we are not responsible for any breach of third-party systems.

(g) Standing with members. USEIA advocates for an election industry in which professionals can do their work without harassment, doxxing, or impersonation. Within that mission, USEIA may publicly or privately stand with members who are targeted, for example by issuing statements, contacting platforms, or supporting members with the press and policymakers. This support is available only to members operating in good faith and in accordance with law and generally accepted industry practices. Whether, when, and how to provide support is in USEIA's sole discretion. USEIA may decline, limit, or withdraw support at any time, including if it learns of facts suggesting unlawful, deceptive, or unethical conduct by the member. Support is not an endorsement of the member, the member's clients, or any candidate, party, or ballot measure, and it does not include legal representation or payment of the member's costs unless the board approves otherwise in writing.

(h) Data handling. We collect and use the information needed to run the service as described in the Privacy Policy, Section 3.13. We use it only to provide the service, protect the member, and keep required records.

(i) Service providers. USEIA may use subcontractors and vendors (for example, data-removal, monitoring, and takedown providers) (names available on request). They are bound by written confidentiality and data-protection obligations and may use member information only to perform the service. USEIA remains responsible to members for the service as described in these Terms.

(j) Termination. The Data-Removal Services end when the membership ends (including on non-renewal or cancellation of auto-renewal at the end of the paid term), when the member revokes the authorization, or if USEIA terminates the membership or the service under the Membership Agreement. When the service ends, we stop submitting new requests. We are not responsible for information that reappears afterward. Requests already submitted may still be processed by third parties. We may suspend the service for any member who provides false information or asks us to make improper requests. USEIA may modify or discontinue the service, or change vendors, on 30 days' notice to members. Because dues are non-refundable, no refund is owed if the service is modified or ends.

1.20 Member Directory

(a) What it is. USEIA publishes an online member directory on ElectionIndustry.com to help the industry find and connect with members.

(b) What is listed. A listing may include: member or firm name; membership type; city and state; business website; business email; business phone; title; services and specialties; logo or professional photo; short bio; "Member since" date. We never list payment information, home addresses, personal phone numbers, personal email addresses, dates of birth, or any information collected for the Data-Removal Services.

(c) Opt-in or opt-out. Listing is opt-in. You will be listed only if you check the directory box at checkout or in your account and choose which fields to show. A directory listing is never a condition of membership. Firm administrators may list designated individuals only with each individual's consent.

(d) Visibility. The directory is publicly viewable by anyone visiting ElectionIndustry.com. Public listings can be viewed, copied, and shared by others, and we cannot control what others do with information you choose to make public.

(e) Search engines and AI crawlers. Directory pages are marked "noindex" and are disallowed in our robots.txt for search engines and known AI crawlers, so they should not appear in search results or be used for AI training by compliant crawlers. Non-compliant crawlers may still access public pages.

(f) Accuracy. You are responsible for keeping your listing accurate and current, and for having the right to post any logo, photo, or content you provide. We may edit or remove listings that are inaccurate, misleading, or that violate our policies. Listing does not mean that USEIA endorses, certifies, or recommends a member.

(g) Removal and changes. You may update your listing, hide optional fields, or remove your listing at any time by emailing Winning@ElectionIndustry.com. We will act on removal requests within 10 business days and remove the listing promptly when a membership ends. Copies made by others, or cached by third parties, before removal are outside our control.

(h) No scraping or misuse. You may not scrape, crawl, harvest, download in bulk, copy, sell, or compile directory information, or use it for unsolicited bulk email, texts, robocalls, list-building, data brokering, or AI training. Directory information may be used only for individual, professional networking. We may use technical measures to prevent scraping. Violations may result in termination of access or membership and legal action.
